1. Who these terms apply to
These Terms of Service (“Terms”) form a binding agreement between New Vantage Co Ltd (“we”, “us”, “SightSync”) and the optical practice (“you”, “the Practice”) that signs up to use the SightSync platform.
By creating an account, you confirm that you are authorised to enter into this agreement on behalf of the Practice and that the Practice is a registered optical practice operating in the United Kingdom.
2. The service
SightSync provides:
- An AI-powered voice calling system to contact lapsed patients about overdue eye examinations
- Automatic WhatsApp and email fallback when calls go unanswered
- SMS appointment confirmation, 24-hour reminders, and personal opt-out links
- Appointment confirmation calls 24–48 hours before each booked appointment
- A patient self-booking portal accessible from any device without an account
- A dashboard for managing patient lists, campaigns, call logs, and analytics
- Integration options with practice management software (PMS) via CSV or direct API
- Google Calendar and Microsoft Calendar integration for appointment booking
SightSync is a communication and workflow tool. It is not a clinical system, does not provide medical advice, and does not replace clinical judgement by qualified optometrists or dispensing opticians.
3. Your responsibilities
As a Practice using SightSync, you agree to:
- Only upload data for your own existing patients — patients with whom you have an active or recent clinical relationship. You must not upload contact lists of individuals who have not previously been your patients.
- Maintain your own ICO registration as a data controller for your patients' data. SightSync acts as your data processor.
- Comply with GOC registration requirements and ensure your practice is registered and in good standing with the General Optical Council.
- Review campaign results and ensure that any booked appointments are followed up with appropriate clinical care.
- Inform patients at the point of their eye test that they may receive an automated AI recall call from your practice. We strongly recommend this as best practice for patient experience and PECR compliance.
- Keep your account credentials secure and notify us immediately of any suspected unauthorised access.
4. What SightSync does not do
To be transparent about the scope of the service:
- SightSync does not guarantee that patients will answer, book, or attend appointments.
- SightSync does not provide legal advice about whether your use of automated calling complies with your specific circumstances.
- SightSync screens all patient numbers against the Telephone Preference Service (TPS) and CTPS before any campaign. TPS-registered numbers are automatically excluded. However, you remain responsible for ensuring your use of the service is lawful for your specific circumstances.
- SightSync is not currently registered with the ICO as a data processor (registration in progress). We operate under your registration as data controller.
5. Subscription and billing
SightSync is offered on a monthly subscription basis. Plans and pricing are listed on our pricing page.
- Free trial: All new accounts receive a 14-day free trial and your first 50 AI calls at no charge.
- Billing: Subscription fees are billed monthly in advance via Stripe. By subscribing you authorise Stripe to charge your payment method on a recurring basis.
- Cancellation: You may cancel at any time from your billing settings. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial months.
- Price changes: We will give at least 30 days' notice of any price increase by email.
6. Acceptable use
You must not use SightSync to:
- Contact individuals who are not your existing patients
- Send marketing or promotional messages unrelated to eye health recall
- Harass, intimidate, or repeatedly contact patients who have opted out
- Attempt to reverse-engineer, scrape, or exploit the platform
- Share your account credentials with other practices or third parties
Breach of these rules may result in immediate suspension of your account without refund.
7. Intellectual property
All software, AI models, scripts, and interfaces that make up SightSync are owned by New Vantage Co Ltd. Your subscription grants you a non-exclusive, non-transferable licence to use the platform for your own practice's patient recall purposes.
Your patient data remains yours. We claim no ownership over it and will return or delete it on request.
8. Limitation of liability
To the maximum extent permitted by UK law, New Vantage Co Ltd will not be liable for:
- Lost revenue from patients who did not book after being called
- Clinical outcomes resulting from missed or delayed appointments
- Any action or claim by a patient arising from receipt of an AI call
- Interruptions to service caused by third-party providers including voice AI services, telephony and messaging services, and cloud infrastructure providers
Our total liability to you in any 12-month period will not exceed the total subscription fees you paid in that period.
9. Data processing
Our Privacy Policy sets out how we process data. By using SightSync, you agree to our Privacy Policy and, where required, to enter into a Data Processing Agreement (DPA) with us. To request a DPA, email care@newvantageco.com.
10. Termination
Either party may terminate the agreement by cancelling the subscription. We may also suspend or terminate your account immediately if:
- You breach these Terms and fail to remedy the breach within 7 days of notice
- You fail to pay subscription fees
- We reasonably believe your use of the platform creates legal or regulatory risk
On termination, your data will be available for export for 90 days, after which it will be permanently deleted.
11. Governing law
These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
